ARBITRATION, A GUARANTEE FOR THE HUMAN RIGHT OF ACCESS TO JUSTICE IN MEXICO

This paper analyzes the conceptual construction of arbitration as a warranty for the human right of access to justice in Mexico. To this end, we review previous studies on human arbitration law, and alternative dispute resolution in light of the 2011 constitutional reform on human rights in Mexico. Finally, we propose a delimitation for the concept of arbitration, not as a human right in itself, but as a warranty that allows protection for access to justice established in the Political Constitution of the United Mexican States and the Inter-American System of Protection of Human Rights.
