This paper examines, from a critical point of view, the rule generally followed which provides that the time limit for the action to claim the price in sales made by businessmen must be determined according to the civil or commercial nature of the sale (period that, according to this idea, would be three years in the first case and five years in the second, by application, respectively, of articles 1967.4º and 1964 of the Civil Code).
