Abstract

The infringement of intellectual and industrial property rights of a cross-border character in the digital environment has resulted in significant case law from the Court of Justice of the European Union, impacting on the interpretation of relevant European regulations when determining the competent jurisdiction to hear such disputes. With its judgment in Case C-104/22 Lännen, a further step forward was taken in the interpretation of the criterion of "targeted activities" in relation to the infringement of a European Union trademark, based on an alleged case of advertising by a competitor of its products by means of their positioning on the internet using the proprietor's trademark.
