This paper addresses some issues relating to the legal regime of the so-called ‘provisional protection’ of trademarks and patents. It analyses, among other controversial aspects, the assumptions on which the right of the trademark or patent applicant to obtain reasonable compensation should be conditioned, the possible extent of this right and the time at which this right may be exercised.
